Introduction to Parole Hearings and Early Release for Prisoners

The demand for lawyers to represent prisoners at oral parole hearings has never been higher. There are over 6,000 prisoners serving indeterminate sentences, with numbers continuing to rise and there are record numbers of prisoners being recalled. All law firms with a crime franchise are able to represent prisoners at these hearings and there is a growing recognition among criminal practitioners that this is a service they need to provide to their clients.

Lecturers: Hamish Arnott is a solicitor at Bhatt Murphy solicitors in London. He was formerly at the Prisoners' Advice Service. Simon Creighton is a solicitor at Bhatt Murphy solicitors in London. He was also formerly at PAS.

Content:

This course aims to provide a comprehensive introduction to the statutory and common law framework which governs the reference for an oral hearing, the structure of the Parole Board and a practical guide to preparing for and representing prisoners at these hearings.

Topics include:

  • the Parole Board, the legal context and its changing role
  • an introduction to conducting oral hearings before the Parole Board
  • an overview of how indeterminate sentences, including IPP sentences, are served
  • details of the various statutory regimes for the early release of those serving determinate and extended sentences including the changes introduced by the Criminal Justice and Immigration Act 2008
  • introduction to other early release schemes such as release on electronic tagging (HDC) and the early removal scheme for foreign nationals
  • remedies for decisions refusing release

The trainers' fees for this course will be donated to the Prisoners' Advice Service.
